By registering for or using PresenceCore, you agree to these Terms of Service. If you do not agree, you may not use the service. These terms apply to all users of the PresenceCore API and console.
PresenceCore is a relational intelligence engine that provides persistent memory, relationship tracking, emotional awareness, and autonomous reflection for AI characters. The service is accessed through a REST API and a web-based console. Our website features an AI spokesperson (Ava) that visitors can interact with via video. Conversations with Ava are transcribed and stored, and any contact information visitors voluntarily share (name, company, phone, email) during those conversations is retained for lead follow-up. We reserve the right to modify, suspend, or discontinue features at any time with reasonable notice.
You must provide accurate information during registration and keep your account information current. You are responsible for safeguarding your API keys and account credentials. You are liable for all activity conducted through your account. You must be at least 13 years old to register.
You agree not to use PresenceCore to: • Generate content that is illegal, harmful, threatening, abusive, harassing, or discriminatory. • Create AI characters that impersonate real individuals without consent. • Deploy AI characters intended to deceive users about their artificial nature where disclosure is legally required. • Attempt to reverse engineer, decompile, or extract the PresenceCore engine or proprietary algorithms. • Exceed your plan's token limits through abusive or automated means. • Resell or redistribute the service without authorization. We reserve the right to suspend accounts that violate these terms.
Paid plans are billed in advance on a monthly or annual basis. Token allowances reset each billing period. If you exceed your token limit, the service will pause until the next cycle or until you upgrade. You can upgrade, downgrade, or cancel at any time; changes take effect at the next billing cycle. Refunds are issued at our discretion for unused portions of a billing period. Enterprise plans are billed per custom agreement.
Each plan includes a monthly token allowance. Tokens are consumed by LLM calls (turns, classifier, inner life) and embeddings. Unused tokens do not roll over. We may impose rate limits to ensure service stability. Character and user counts are not hard-limited — token consumption is the natural ceiling.
You retain all rights to your character configurations, conversation data, and derived content generated through the service. PresenceCore retains all rights to the engine, algorithms, and service infrastructure. Your use of the service does not grant you any rights to our intellectual property.
Both parties agree to keep confidential any non-public information shared during the course of the service relationship, including character configurations, conversation data, and proprietary technical details. This obligation survives termination of the service.
You may terminate your account at any time. We may terminate or suspend accounts that violate these terms, fail to pay, or pose a security risk. Upon termination, your data is retained for 30 days then permanently deleted, unless you request earlier deletion. Sections that by their nature should survive termination (intellectual property, confidentiality, limitation of liability) remain in effect.
The service is provided "as is" without warranties of any kind. We do not guarantee that AI responses will be accurate, appropriate, or free from errors. The service may experience outages, latency, or model provider failures. You are responsible for reviewing AI-generated content before delivering it to your end users.
To the maximum extent permitted by law, PresenceCore shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or profits. Our total liability for any claim shall not exceed the amount you paid in the 30 days preceding the claim.
These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts having jurisdiction over our principal place of business.
We may update these Terms of Service from time to time. We will notify you of material changes by email or through the console. Continued use of the service after changes constitutes acceptance of the updated terms.
